Az adatokat megfelel\u0151 int\u00e9zked\u00e9sekkel v\u00e9di k\u00fcl\u00f6n\u00f6sen a jogosulatlan hozz\u00e1f\u00e9r\u00e9s, megv\u00e1ltoztat\u00e1s, tov\u00e1bb\u00edt\u00e1s, nyilv\u00e1noss\u00e1gra hozatal, t\u00f6rl\u00e9s vagy megsemmis\u00edt\u00e9s, valamint a v\u00e9letlen megsemmis\u00fcl\u00e9s \u00e9s s\u00e9r\u00fcl\u00e9s, tov\u00e1bb\u00e1 az alkalmazott technika megv\u00e1ltoz\u00e1s\u00e1b\u00f3l fakad\u00f3 hozz\u00e1f\u00e9rhetetlenn\u00e9 v\u00e1l\u00e1s ellen.<\/p>

A k\u00fcl\u00f6nb\u00f6z\u0151 nyilv\u00e1ntart\u00e1sokban elektronikusan kezelt adat\u00e1llom\u00e1nyok v\u00e9delme \u00e9rdek\u00e9ben megfelel\u0151 technikai megold\u00e1ssal biztos\u00edtja, hogy a nyilv\u00e1ntart\u00e1sokban t\u00e1rolt adatok - kiv\u00e9ve, ha azt t\u00f6rv\u00e9ny lehet\u0151v\u00e9 teszi - k\u00f6zvetlen\u00fcl ne legyenek \u00f6sszekapcsolhat\u00f3k \u00e9s az \u00e9rintetthez rendelhet\u0151k.<\/p>

A szem\u00e9lyes adatok automatiz\u00e1lt feldolgoz\u00e1sa sor\u00e1n az adatkezel\u0151 \u00e9s az adatfeldolgoz\u00f3 tov\u00e1bbi int\u00e9zked\u00e9sekkel biztos\u00edtja<\/p>

a)\u00a0\u00a0\u00a0\u00a0\u00a0 a jogosulatlan adatbevitel megakad\u00e1lyoz\u00e1s\u00e1t;<\/p>

b)\u00a0\u00a0\u00a0\u00a0 az automatikus adatfeldolgoz\u00f3 rendszerek jogosulatlan szem\u00e9lyek \u00e1ltali, adat\u00e1tviteli berendez\u00e9s seg\u00edts\u00e9g\u00e9vel t\u00f6rt\u00e9n\u0151 haszn\u00e1lat\u00e1nak megakad\u00e1lyoz\u00e1s\u00e1t;<\/p>

c)\u00a0\u00a0\u00a0\u00a0\u00a0 annak ellen\u0151rizhet\u0151s\u00e9g\u00e9t \u00e9s meg\u00e1llap\u00edthat\u00f3s\u00e1g\u00e1t, hogy a szem\u00e9lyes adatokat adat\u00e1tviteli berendez\u00e9s alkalmaz\u00e1s\u00e1val mely szerveknek tov\u00e1bb\u00edtott\u00e1k vagy tov\u00e1bb\u00edthatj\u00e1k;<\/p>

d)\u00a0\u00a0\u00a0\u00a0 annak ellen\u0151rizhet\u0151s\u00e9g\u00e9t \u00e9s meg\u00e1llap\u00edthat\u00f3s\u00e1g\u00e1t, hogy mely szem\u00e9lyes adatokat, mikor \u00e9s ki vitte be az automatikus adatfeldolgoz\u00f3 rendszerekbe;<\/p>

e)\u00a0\u00a0\u00a0\u00a0\u00a0 a telep\u00edtett rendszerek \u00fczemzavar eset\u00e9n t\u00f6rt\u00e9n\u0151 helyre\u00e1ll\u00edthat\u00f3s\u00e1g\u00e1t \u00e9s<\/p>

f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 azt, hogy az automatiz\u00e1lt feldolgoz\u00e1s sor\u00e1n fell\u00e9p\u0151 hib\u00e1kr\u00f3l jelent\u00e9s k\u00e9sz\u00fclj\u00f6n.<\/p>

Az Adatkezel\u0151 \u00e9s az adatfeldolgoz\u00f3 az adatok biztons\u00e1g\u00e1t szolg\u00e1l\u00f3 int\u00e9zked\u00e9sek meghat\u00e1roz\u00e1sakor \u00e9s alkalmaz\u00e1sakor tekintettel van a technika mindenkori fejletts\u00e9g\u00e9re. T\u00f6bb lehets\u00e9ges adatkezel\u00e9si megold\u00e1s k\u00f6z\u00fcl azt v\u00e1lasztja, amely a szem\u00e9lyes adatok magasabb szint\u0171 v\u00e9delm\u00e9t biztos\u00edtja, kiv\u00e9ve, ha az ar\u00e1nytalan neh\u00e9zs\u00e9get jelentene az Adatkezel\u0151nek.<\/p>

Az Adatkezel\u0151 a k\u00e9relmeket \u00e9s panaszokat a legr\u00f6videbb id\u0151n bel\u00fcl, legfeljebb azonban 30 nap alatt a lev\u00e9lben megjel\u00f6lt c\u00edmre v\u00e1laszolja meg.<\/p>

INCIDENSKEZEL\u00c9S<\/p>

Az adatv\u00e9delmi incidens fogalma<\/p>

A biztons\u00e1g olyan s\u00e9r\u00fcl\u00e9se, amely a tov\u00e1bb\u00edtott, t\u00e1rolt vagy m\u00e1s m\u00f3don kezelt szem\u00e9lyes adatok v\u00e9letlen vagy jogellenes megsemmis\u00edt\u00e9s\u00e9t, elveszt\u00e9s\u00e9t, megv\u00e1ltoztat\u00e1s\u00e1t, jogosulatlan k\u00f6zl\u00e9s\u00e9t vagy az azokhoz val\u00f3 jogosulatlan hozz\u00e1f\u00e9r\u00e9st eredm\u00e9nyezi.<\/p>

Az Adatkezel\u0151 int\u00e9zked\u00e9sei incidens \u00e9szlel\u00e9se eset\u00e9n:<\/p>

Az Adatkezel\u0151 indokolatlan k\u00e9sedelem n\u00e9lk\u00fcl, \u00e9s ha lehets\u00e9ges, legk\u00e9s\u0151bb 72 \u00f3r\u00e1val<\/u> azut\u00e1n, hogy az adatv\u00e9delmi incidens a tudom\u00e1s\u00e1ra jutott k\u00f6teles azt bejelenteni az illet\u00e9kes fel\u00fcgyeleti hat\u00f3s\u00e1gnak, kiv\u00e9ve, ha az adatv\u00e9delmi incidens val\u00f3sz\u00edn\u0171s\u00edthet\u0151en nem j\u00e1r kock\u00e1zattal a term\u00e9szetes szem\u00e9lyek jogaira \u00e9s szabads\u00e1gaira n\u00e9zve.<\/p>

Ha az adatv\u00e9delmi incidens val\u00f3sz\u00edn\u0171s\u00edthet\u0151en magas kock\u00e1zattal j\u00e1r a term\u00e9szetes szem\u00e9lyek jogaira \u00e9s szabads\u00e1gaira n\u00e9zve, az Adatkezel\u0151 indokolatlan k\u00e9sedelem n\u00e9lk\u00fcl t\u00e1j\u00e9koztatja az \u00e9rintettet az adatv\u00e9delmi incidensr\u0151l.<\/p>

A bejelent\u00e9snek legal\u00e1bb az al\u00e1bbiakat kell tartalmaznia:<\/p>

a)\u00a0\u00a0\u00a0\u00a0\u00a0 ismertetni kell az adatv\u00e9delmi incidens jelleg\u00e9t, bele\u00e9rtve - ha lehets\u00e9ges - az \u00e9rintettek kateg\u00f3ri\u00e1it \u00e9s hozz\u00e1vet\u0151leges sz\u00e1m\u00e1t, valamint az incidenssel \u00e9rintett adatok kateg\u00f3ri\u00e1it \u00e9s hozz\u00e1vet\u0151leges sz\u00e1m\u00e1t;<\/p>

b)\u00a0\u00a0\u00a0\u00a0 k\u00f6z\u00f6lni kell az adatv\u00e9delmi tisztvisel\u0151 vagy a tov\u00e1bbi t\u00e1j\u00e9koztat\u00e1st ny\u00fajt\u00f3 egy\u00e9b kapcsolattart\u00f3 nev\u00e9t \u00e9s el\u00e9rhet\u0151s\u00e9geit;<\/p>

c)\u00a0\u00a0\u00a0\u00a0\u00a0 ismertetni kell az adatv\u00e9delmi incidensb\u0151l ered\u0151, val\u00f3sz\u00edn\u0171s\u00edthet\u0151 k\u00f6vetkezm\u00e9nyeket;<\/p>

d)\u00a0\u00a0\u00a0\u00a0 ismertetni kell az Adatkezel\u0151 \u00e1ltal az adatv\u00e9delmi incidens orvosl\u00e1s\u00e1ra tett vagy tervezett int\u00e9zked\u00e9seket, bele\u00e9rtve adott esetben az adatv\u00e9delmi incidensb\u0151l ered\u0151 esetleges h\u00e1tr\u00e1nyos k\u00f6vetkezm\u00e9nyek enyh\u00edt\u00e9s\u00e9t c\u00e9lz\u00f3 int\u00e9zked\u00e9seket.<\/p>

1.4.\u00a0\u00a0\u00a0 Az Adatkezel\u0151 nyilv\u00e1ntartja az adatv\u00e9delmi incidenseket, felt\u00fcntetve az adatv\u00e9delmi incidenshez kapcsol\u00f3d\u00f3 t\u00e9nyeket, annak hat\u00e1sait \u00e9s az orvosl\u00e1s\u00e1ra tett int\u00e9zked\u00e9seket.<\/p>

9.5 Az \u00e9rintettet nem kell az adatv\u00e9delmi incidensr\u0151l t\u00e1j\u00e9koztatni, ha<\/p>

a)\u00a0\u00a0\u00a0\u00a0\u00a0 az Adatkezel\u0151 megfelel\u0151 technikai \u00e9s szervez\u00e9si v\u00e9delmi int\u00e9zked\u00e9seket hajtott v\u00e9gre, \u00e9s_ezeket az int\u00e9zked\u00e9seket az adatv\u00e9delmi incidens \u00e1ltal \u00e9rintett adatok tekintet\u00e9ben alkalmazt\u00e1k, k\u00fcl\u00f6n\u00f6sen azokat az int\u00e9zked\u00e9seket - mint p\u00e9ld\u00e1ul a titkos\u00edt\u00e1s alkalmaz\u00e1sa -, amelyek a szem\u00e9lyes adatokhoz val\u00f3 hozz\u00e1f\u00e9r\u00e9sre fel nem jogos\u00edtott szem\u00e9lyek sz\u00e1m\u00e1ra \u00e9rtelmezhetetlenn\u00e9 teszik az adatokat;<\/p>

b)\u00a0\u00a0\u00a0\u00a0 az Adatkezel\u0151 az adatv\u00e9delmi incidenst k\u00f6vet\u0151en olyan tov\u00e1bbi int\u00e9zked\u00e9seket tett, amelyek biztos\u00edtj\u00e1k, hogy az \u00e9rintett jogaira \u00e9s szabads\u00e1gaira jelentett magas kock\u00e1zat a tov\u00e1bbiakban val\u00f3sz\u00edn\u0171s\u00edthet\u0151en nem val\u00f3sul meg;<\/p><\/td><\/tr><\/tbody><\/table>

a t\u00e1j\u00e9koztat\u00e1s ar\u00e1nytalan er\u0151fesz\u00edt\u00e9st tenne sz\u00fcks\u00e9gess\u00e9. (Ilyen esetekben az \u00e9rintetteket nyilv\u00e1nosan k\u00f6zz\u00e9tett inform\u00e1ci\u00f3k \u00fatj\u00e1n kell t\u00e1j\u00e9koztatni, vagy olyan hasonl\u00f3 int\u00e9zked\u00e9st kell hozni, amely biztos\u00edtja az \u00e9rintettek hasonl\u00f3an hat\u00e9kony t\u00e1j\u00e9koztat\u00e1s\u00e1t.)<\/p>

Az illet\u00e9kes hat\u00f3s\u00e1g utas\u00edthatja az Adatkezel\u0151t, hogy t\u00e1j\u00e9koztassa az \u00e9rintettet az adatv\u00e9delmi incidensr\u0151l (GDPR 58. cikk (2) e) pont).<\/p>

AZ ADATKEZEL\u00c9S \u00c9RINTETTJEINEK JOGAI<\/p>

A szem\u00e9lyes adatkezel\u00e9ssel \u00e9rintetteket a jogszab\u00e1lyok alapj\u00e1n az al\u00e1bbi jogok illetik meg:<\/p>

a)\u00a0\u00a0\u00a0\u00a0\u00a0 hozz\u00e1f\u00e9r\u00e9si jog<\/strong>: adatok megismer\u00e9se, az a t\u00e9ny, hogy t\u00f6rt\u00e9nik-e adatkezel\u00e9s;<\/p>

b)\u00a0\u00a0\u00a0\u00a0 helyesb\u00edt\u00e9shez val\u00f3 jog<\/strong>: pontatlan, helytelen adatok kiigaz\u00edt\u00e1sa;<\/p>

c)\u00a0\u00a0\u00a0\u00a0\u00a0 t\u00f6rl\u00e9shez val\u00f3 jog<\/strong>: kiz\u00e1r\u00f3lag a hozz\u00e1j\u00e1rul\u00e1son alapul\u00f3 adatkezel\u00e9s eset\u00e9n, a visszavon\u00e1s nem \u00e9rinti a visszavon\u00e1s el\u0151tt a hozz\u00e1j\u00e1rul\u00e1s alapj\u00e1n v\u00e9grehajtott adatkezel\u00e9s jogszer\u0171s\u00e9g\u00e9t);<\/p>

d)\u00a0\u00a0\u00a0\u00a0 az adat kezel\u00e9s\u00e9nek korl\u00e1toz\u00e1sa<\/strong>: ha a felhaszn\u00e1l\u00f3 vitatja a vele kapcsolatosan t\u00e1rolt adatok pontoss\u00e1g\u00e1t, ha az adatkezel\u00e9s jogellenes \u00e9s m\u00e1r nincs sz\u00fcks\u00e9g az adatra, de nem szeretn\u00e9, az adatot a felhaszn\u00e1l\u00f3 t\u00f6r\u00f6lni, vagy sz\u00fcks\u00e9ge van ezekre jogi ig\u00e9nyek el\u0151terjeszt\u00e9s\u00e9hez, \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9hez vagy ellen\u00fck val\u00f3 v\u00e9dekez\u00e9shez vagy, ha tiltakozott az adatkezel\u00e9s ellen;<\/p>

e)\u00a0\u00a0\u00a0\u00a0\u00a0 adathordozhat\u00f3s\u00e1ghoz val\u00f3 jog<\/strong>: az \u00e9rintett jogosult arra, hogy a r\u00e1 vonatkoz\u00f3, \u00e1ltala az Adatkezel\u0151 rendelkez\u00e9s\u00e9re bocs\u00e1tott szem\u00e9lyes adatokat tagolt, sz\u00e9les k\u00f6rben haszn\u00e1lt, g\u00e9ppel olvashat\u00f3 form\u00e1tumban megkapja, tov\u00e1bb\u00e1 jogosult arra, hogy ezeket az adatokat egy m\u00e1sik Adatkezel\u0151nek tov\u00e1bb\u00edtsa an\u00e9lk\u00fcl, hogy ezt akad\u00e1lyozn\u00e1 az az Adatkezel\u0151, amelynek a szem\u00e9lyes adatokat a rendelkez\u00e9s\u00e9re bocs\u00e1totta;<\/p>

f)\u00a0\u00a0\u00a0\u00a0\u00a0 tiltakoz\u00e1s a szem\u00e9lyes adat kezel\u00e9se ellen: <\/strong>az \u00e9rintett jogosult arra, hogy a saj\u00e1t helyzet\u00e9vel kapcsolatos okokb\u00f3l b\u00e1rmikor tiltakozzon szem\u00e9lyes adatainak a 6. cikk (1) bekezd\u00e9s\u00e9nek e) vagy f) pontj\u00e1n alapul\u00f3 kezel\u00e9se ellen, ide\u00e9rtve az eml\u00edtett rendelkez\u00e9seken alapul\u00f3 profilalkot\u00e1st is. Ebben az esetben az Adatkezel\u0151 a szem\u00e9lyes adatokat nem kezelheti tov\u00e1bb, kiv\u00e9ve, ha az Adatkezel\u0151 bizony\u00edtja, hogy az adatkezel\u00e9st olyan k\u00e9nyszer\u00edt\u0151 erej\u0171 jogos okok indokolj\u00e1k, amelyek els\u0151bbs\u00e9get \u00e9lveznek az \u00e9rintett \u00e9rdekeivel, jogaival \u00e9s szabads\u00e1gaival szemben, vagy amelyek jogi ig\u00e9nyek el\u0151terjeszt\u00e9s\u00e9hez, \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9hez vagy v\u00e9delm\u00e9hez kapcsol\u00f3dnak.<\/p>
